Thank you for choosing our software. This End User License Agreement outlines the terms and conditions under which you may use the Simple DMX Controller software (the “Software”).

By installing, purchasing, downloading, or using the Software, you agree to comply with and be bound by these terms. If you do not agree, do not install or use the Software.

Before purchasing a license, it is your responsibility to ensure the Software is compatible with your hardware and meets your needs. This Agreement also provides an overview of your rights, obligations, and the Seller’s responsibilities.

1. Privacy and Data Collection
License Management: We collect MAC addresses from your device to register and reactivate your license. Your email address is collected during the purchase and license registration process (on our website, not within the Software) to send important communications and updates related to the Software.
Anonymous Usage Statistics: When you install or update the Software, it may collect anonymous technical data to help us understand usage patterns and improve the Software. This includes: software version, installation time, and country (derived from your IP address). Your IP address is used to determine your country for anonymous statistics. IP addresses are also stored for abuse prevention purposes as described in our Privacy & Cookies Policy. No personal information such as your name or email address is collected through the Software.
Network Connections: The Software connects to the following external services during normal operation:
• license.simpledmx.net – for license validation and activation
• app.simpledmx.net – for anonymous install/update tracking
• pool.ntp.org – for time verification (used to validate license dates)
An internet connection may be required for license activation, reactivation, and date verification. The Software may also open links to buy.simpledmx.net and forum.simpledmx.net in your default web browser.
Data Use: Collected data is used solely for license management, technical analytics, product improvement, and internal statistics. Data is not used for marketing or sold to third parties, except when disclosure is legally required.
Your Rights: You have the right to request access to, correction of, or deletion of your data. If you wish to opt out of anonymous usage data collection or exercise any data protection rights, please contact us at the email address provided on our website.

2. License Terms
Each license is for a single user on one device. Licenses are non-transferable and may not be sold, assigned, or shared. Any attempt to transfer a license voids it immediately.

3. License Expiration, Grace Period, and Deactivation
Licenses are valid for the period specified at the time of purchase. When a license expires, the Software will enter a grace period during which it remains fully functional. The duration of this grace period is determined by the Seller and may change between versions.
If the license is not renewed before the grace period ends, the Software will revert to time-limited trial mode. In time-limited trial mode, the Software will function normally but will automatically close after a set period of use per session.
If the Software detects a date conflict (for example, if the system clock has been set back), DMX output may be disabled until the correct date is verified. An internet connection may be required to resolve date conflicts.

4. Refund Policy
Refunds are available only if the license has not been activated and the request is made within 31 days of the purchase.

5. Compatibility and Testing
Users must verify hardware compatibility using the free trial before purchasing a license. Completing a purchase indicates confirmation that the Software works as intended on the user’s system.

6. First Release Notice
This Software is in its initial release. It may contain bugs, performance issues, or other unexpected behavior. User feedback is welcome and helps improve future updates.

7. Hardware Recommendations
Art-Net devices are recommended for best results. If using a USB DMX device, a “pro” version with a built-in processor is strongly advised to ensure signal stability. Use of low-cost Open DMX devices is discouraged due to the risk of signal dropouts and erratic behavior. These devices are not suitable for professional or critical environments.

8. Intended Use
This Software is intended only for use with DMX-controllable lighting fixtures, atmospheric effects machines (such as smoke and haze machines), and related stage equipment. Use with any other type of device is strictly prohibited.
Laser Prohibition: The use of the Software for controlling laser fixtures is strictly prohibited. Laser equipment poses serious safety risks including permanent eye damage, and the Software is not designed or certified for laser control.
The User is solely responsible for ensuring that all connected fixtures and equipment are safe for their intended use and comply with all applicable safety regulations and local laws. Users must also comply with all laws and regulations concerning DMX equipment in their jurisdiction.

9. Software Updates and Uninstalling
Settings will be retained during normal updates. However, major updates may require you to set up the Software again. Proceeding with an update implies acceptance of this condition.
Important: Uninstalling the Software will permanently delete all settings, show files, fixture configurations, and scenes. Users are strongly advised to back up their data before uninstalling. The Seller is not responsible for any data loss resulting from uninstalling or updating the Software.

10. Prohibition of Modifications
Users may not alter, modify, reverse engineer, decompile, disassemble, or tamper with the Software. Unauthorized modifications will result in immediate license termination and may result in legal consequences.

11. Disclaimer of Liability
The Software is provided “as is” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Seller shall not be held liable for any direct, indirect, incidental, consequential, or special damages, including but not limited to financial losses, loss of business opportunities, equipment damage, data loss, or reputational harm, arising from or related to the use of the Software.
The End User acknowledges and agrees that any issues experienced during events or other operations, including malfunctions, errors, software crashes, DMX signal interruptions, or failures of the Software, are solely at the End User’s own risk.
To the maximum extent permitted by applicable law, the Seller’s total aggregate liability arising out of or in connection with this Agreement shall not exceed the total amount paid by the User for the Software license in the twelve (12) months preceding the event giving rise to the claim.

12. Service Availability
The Seller makes reasonable efforts to maintain the availability of license activation servers and related online services, but does not guarantee uninterrupted access. The Seller is not liable for any interruptions, downtime, or unavailability of online services caused by server maintenance, technical issues, network failures, or circumstances beyond the Seller’s reasonable control.

13. Legal Compliance
Users must ensure that their use of the Software complies with all applicable laws and regulations in their jurisdiction. The Seller holds no responsibility for any legal issues arising from misuse or violation of local laws by the User.

14. Data Security
We use appropriate technical and organizational safeguards to protect your personal data in accordance with applicable data protection regulations.

15. Your Data Protection Rights
Depending on your jurisdiction, you may have rights including: access to your personal data, correction of inaccurate data, deletion of your data, restriction of processing, objection to processing, and data portability. 16. Age Requirement
You must be at least 16 years of age to use the Software and agree to this EULA. If you are under 16, you may only use the Software with the consent and supervision of a parent or legal guardian who agrees to be bound by this Agreement.

17. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Denmark. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Denmark.

18. Privacy Policy Changes
We may update our Privacy Policy at any time. Changes become effective upon being posted on our website. Continued use of the Software after changes are posted constitutes acceptance of the updated Privacy Policy.

19. Entire Agreement
This Agreement constitutes the entire agreement between the User and the Seller regarding the use of the Software and supersedes all prior agreements, understandings, and representations.

20. Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
